PURPOSE

The purpose of this Department Order is to establish guidelines for the investigation and prosecution of inmates, employees, visitors, or any other individuals committing crimes while in the Department's jurisdiction. Crimes are immediately reported, crime scenes are protected and investigations are conducted in a prompt and professional manner.

PROCEDURES

608.01 CONSTITUTIONAL RIGHTS OF PERSONS

1.1 The investigator shall advise the person of his or her Constitutional Rights at the time an interview focuses on the person as a suspect in a crime.

1.2 At the point that a person is advised of his of her Constitutional Rights, the person is entitled to have legal counsel present.

608.02 NEW CRIMES BY RELEASED INMATES

1.1 When a released inmate is not under community supervision or escape status and commits a new crime, the decision to prosecute is made by the appropriate law enforcement agency and County Attorney. The Department shall not be responsible for prosecution or jail housing costs.

1.2 In the event that the prosecutor asks to consult with the Department about the case, the appropriate staff shall prepare by reviewing the following:

1.2.1 Earned Release Credits (ERC) accumulated.

1.2.2 ERC earning capability.

1.2.3 Disciplinary options.

1.2.4 Time remaining until sentence expiration.

1.2.5 Time spent on release status.

608.03 NEW CRIMES BY COMMUNITY CORRECTIONS INMATES - When an inmate who is on release status under community supervision commits a new crime and is arrested and placed in jail, the Department places a hold on the inmate.

1.1 In the event that the prosecutor asks to consult with the Department about the case, the appropriate Community Corrections staff shall prepare by reviewing the following:

1.1.1 ERC accumulated.

1.1.2 ERC earning capability.

1.1.3 Disciplinary and/or classification options.

1.1.4 Time remaining until sentence expiration.

1.1.5 Time spent on release status.

1.2 If the decision is to not prosecute, the Department shall transport the inmate to a Departmental institution as a violator of community supervision, after which the inmate shall be scheduled for a revocation hearing by the Board of Executive Clemency as outlined in Department Order #1002, Inmate Release Eligibility System.

1.3 If the inmate is prosecuted and convicted, the inmate shall be returned to the Department's custody with a new commitment, after which the Board of Executive Clemency schedules a revocation hearing. The Department shall be responsible for housing costs beginning the day after notification that the inmate has been sentenced to the Department.

IMPLEMENTATION

The Chief of Staff shall maintain, and when appropriate update, the Criminal Investigations Technical Manual. The Technical Manual shall address, at a minimum, the following:

Use of force procedures for Criminal Investigators.

Weapons qualification and authorization to carry.
