This Department Order establishes a system for the Department to place, remove and release inmates and offenders from Community Correctional Centers. The Community Correctional Centers are used to assist inmates who are eligible for release in preparing for and making a successful transition into the community.
1006.01 ELIGIBILITY CRITERIA - GENERAL POPULATION
1.1 To be eligible for transfer to a Community Correctional Center (CCC), inmates shall:
1.1.1 Not be more than 18 months from their parole certification date. Inmates may apply for transfer to a CCC when they are within 20 months of their parole certification date.
1.1.2 Have a Correctional Classification Profile (CCP) Public Risk (P) score of two or less, and an Institutional Risk (I) score of three or less.
1.1.2.1 Inmates with a P/I score of 2/3 shall have demonstrated a positive institutional adjustment with a period of positive programming and work effort.
1.1.2.2 Inmates with a P/I score of 2/3 shall not be accepted directly from a reception center, but shall be reviewed on a case by case basis, based upon:
1.1.2.2.1 Community stability.
1.1.2.2.2 Educational/vocational needs.
1.1.2.2.3 Length of sentence.
1.1.2.2.4 Substance abuse history.
1.1.3 Have no pending classification action that could result in a higher CCP score.
1.1.4 Have a Sex Crime (S) score of 1.
1.1.5 Have a Medical (M) score of 2 or less.
1.1.6 Have a Mental Health (MH) score of 3 or less.
1.1.6.1 Inmates with a Mental Health score of 3 shall be cleared by the Mental Health Unit of the sending institution for placement at a CCC.
1.1.7 Have no history of escaping, absconding or failure to return within the previous three years.
1.1.8 Have no major disciplinary convictions six months prior to the date of application for CCC placement.
1.1.9 Have no detainers, wants or warrants from any jurisdiction.
1.1.10 Be approved for transfer by the Deputy Warden.
1.2 All general population inmates shall be approved for CCC placement by Central Classification prior to transfer.
1.3 Release violators may be considered for transfer, if the violation was not for absconding, escaping or a new charge.
1.4 The Division Director for Offender Operations may approve exceptions to placement criteria.
1006.02 CCC ELIGIBILITY CRITERIA - RELEASEES
1.1.1 Be approved by the Arizona Board of Executive Clemency (Board) for work furlough status pursuant to Arizona Revised Statutes (ARS) 31-233 or ARS 41-1604.11.
1.1.2 Be approved by the Board for in-state parole or Home Arrest, pursuant to ARS 31-412 or ARS 41-1604.13.
1.1.3 Be within 90 days of their mandatory release date.
1.1.3.1 If the statute under which an inmate was sentenced precludes release from confinement on any basis before a specific sentence is served, the inmate shall first serve the required time or portion of the sentence.
1.1.4 Be approved for, and within 120 days of, their Provisional Release date.
1.1.5 Be within 120 days of their Earned Release Credit Date or Sentence Expiration Date.
1.1.6 Have the following CCP scores:
1.1.6.1 "P" score of 3 or less.
1.1.6.2 "I" score of 3 or less.
1.1.6.3 "M" score of 2 or less. (An inmate with a score of 3 may be considered on an individual basis.)
1.1.6.4 "MH" score of 3 or less.
1.2 The Division Director for Offender Operations or designee may approve a waiver of the preceding criteria when in the best interest of the Department.
1006.03 EXCEPTIONS TO CRITERIA
1.1.1 The recommendation is in the best interest of the public and the Department.
1.1.2 The Correctional Officer III has completed a minimum of two attempts to locate an alternative community placement for the inmate.
1.1.3 The Time Computation Unit has identified the inmate as eligible for immediate release. (See Department Order #1001, Inmate Release System.)
1.1.3.1 Inmates who are in protective segregation status shall not become eligible for transfer to a CCC until the date of release eligibility.
1.2 Institutional staff shall forward the recommendation to the Offender Services Administrator for review and approval.
1.3 Upon approval, the Offender Services Administrator authorizes Central Classification to approve the order to transport the inmate.
1006.04 PLACEMENT AND DISQUALIFICATION
1.2 Inmates meeting the criteria shall be eligible for transfer to a CCC upon availability of bed space and approval of Central Classification.
1.3 The CCC Offender Information Unit shall screen inmates for placement from the list of inmates who have been granted a Board release or from release packets forwarded by institutional staff to the Community Corrections Division.
1.4 Disqualification - A general population or pre-release inmate shall not be eligible for placement if, during the previous six months, the inmate was returned to an institution for a violation of Department or Board conditions of supervision, or was returned to a higher custody level from a CCC.
1006.05 ADMINISTRATOR RESPONSIBILITIES - The CCC Administrator shall ensure:
1.1.1 An orientation and a handbook that explains the rules and expectations.
1.1.2 Counseling services.
1.1.3 Room, board and supervision that includes housing, standard meals each day and supervision 24 hours per day.
1.1.4 Success Skills or Life Skills classes that include instruction in essential activities, e.g., personal care, financial planning, health care and job-finding skills, required to meet personal, physical and social needs.
1.1.5 Job development that includes assistance in obtaining employment for job ready individuals.
1.1.6 Clothing as allowed in Department Order #909, Inmate Mail/Property and Stores.
1.2 CCC general population inmates, pre-release inmates/releasees:
1.2.1 Attend orientation and meet with their assigned Correctional Officer III within two workdays of placement at the CCC.
1.2.2 Participate in programs as directed by the assigned Correctional Officer III.
1.2.3 Accept work assignments required for the care and maintenance of the CCC.
1.3 Releasees obtain employment and save a sufficient amount of money to establish residence in the community, independent of the CCC, within 60 days of arrival at the CCC. The releasee may request an extension from the CCC Administrator.
1006.06 REMOVAL AND RELEASE
1.1.1 Disciplinary or classification actions.
1.1.2 The CCC Administrator determines that the general population/pre-release inmate/releasee poses a threat that endangers the safety of the public or security of the CCC, as the result of a violation of the conditions of supervision or CCC Institution Orders.
1.2 Release - A general population inmate/pre-release inmate/releasee may be released from a CCC when:
1.2.1 The Earned Release Credit Date or Sentence Expiration Date is reached, and a release confirmation has been received from the Time Computation Unit in accordance with Department Order #1002, Inmate Release System.
1.2.2 The supervision is transferred to Community Corrections.
